1. Introduction. The present general conditions of use in the mobile application Fluohazard regulate the terms and conditions to access and use the www.apexar.com, owned by Apexar Technologies S.A., hereinafter APEXAR, which the user will have to read and accept to be able to use all the services and informations which are given from the application. The simple access and/or use of the application of all of part of its contents and /or services mean the absolute acceptance of the present general conditions of use. 2. Conditions of use. The present general conditions of use of the application regulate the access and use of the application including the contents and services set to the disposition of the users in and/or through the application whether by the users or third parties. Nevertheless the access and use of certain contents and/or services may be submitted to determined specific conditions. 3. Modifications. The company reserves the right to modify at any time the general conditions of use of the application. In any case, it is recommended the periodical consult of the present terms of use of the application, since they can be modified.  4. User obligations. At any time the user shall follow the terms and conditions established in the present general conditions for the use of the application. The user expressly states that the application will  be used diligently and assuming any liability arising from the breach of the rules. At the same time the user will not be able to use the application to transmit, store, disclose, promote or distribute data or contents that may be carriers of viruses or any other computer code, files or programs designed to interrupt, destroy or impair the operation of any program or computer or telecommunication equipment. 5.  Liability of the application. The user knows and accepts that the application does not grant  guarantee of any nature, whether express or implicit, about the data, contents, information and services that are incorporated and offered from the application. Except for the cases in which  Law expressly imposes otherwise, and exclusively with the measure and extent to which it imposes it, the application neither guarantees nor assumes any responsibility with respect to the possible damages and prejudices caused by the use and handling of the information, data and application services. In any case the application excludes any liability for the damages and prejudices that may be due to the information and/or provided services or produced by third parties other than the company. The third party whether supplier or collaborator will be liable for everything. 6. Intellectual and industrial property. Every content, brand, logo, drawing, documentation, computer program or any other element susceptible of protection by the legislation of intellectual or industrial property, accessible in the application, corresponds exclusively to the company or its legitimate holders and all rights over them are expressly reserved. The creation of hypertext (links) to any element integrating the application is absolutely forbidden without the authorization of the company, provided they are not an application / web that does not require identification or authentication for access, or the same is restricted. In any case the company reserves all the rights on the contents, information, data and services shown on the application. The company does not provide any license or authorization for the use of the application regarding the contents, data or services to the user, other than the expressly detailed in the general present conditions.  7. Applicable law, competent jurisdiction and notifications. These conditions are governed and interpreted in accordance with the Laws of Argentina. The courts of San Isidro will be competent for any claim. All the notifications, requests and other communications that the User wishes to make to the Company that owns the application must be made in writing and it will be understood that they have been correctly made when received at the following address: Uruguay 2887, Victoria, Buenos Aires , Argentina.
